JLA's assertion that the facts of Roe v. Wade are "cooked" is false, and he knows it. The only thing "Roe" lied about was that she told her lawyers she was raped, when actually she had an affair. That wasn't an issue in her case, and JLA, a lawyer, knows it. "Roe" was pregnant when she filed suit, and she said she wanted an abortion. That was legally sufficient.

Point well taken.

Would that qualify as substantive, then? Some will be disappointed.

In any event, I believe the answer to your question (in true lawyer fashion)as to whether Roe is good law depends. It depends on how you view the law in general. Whether the law (in a Constitutional law context)is viewed solely as a bulwark to protect us as individuals from unwarranted government intrusion in our lives to be strictly and narrowly construed or whether Constitutional law presents an opportunity to create new rights and fill in the gaps left open by the folks who are selected to legislate and are thus accountable for their actions.
