Lots of attorneys - conservatives and democrats- misuse the courts for their own purposes. This is certainly true and I agree. As to the rest, I guess it depends on whose Ox is being gored to a large extent. I favor strict construction and the concept that the Court are not there to provide a remedy for EVERY imaginable claim. I also believe in the separation of powers and if the legislature fails to act, the voters can hold them accountable (and if they don't they have no reason to complain).
