As for pundits, I agree. But clients can educate their attorneys, and the attorneys can educate the judge, so there's really no "grasp of the current technology" defense.

Or it could be that the attorneys have no defensible position to work with. Maybe Microsoft's position is so damning that this is the most competent handling of a case in their firm's history. Their defense may have been to obtain a ruling that is defensible/overturnable in the appellate arena.
