MKB,

The key potential problem to GMST, IMO, is the convergence of TV and PC/internet. How do you think GMST will fare in this battle?

Having just read your post and a few posts after I have a few comments.

Whether its PC to TV or TV to PC Gemstar is well positioned with its intellectual property, alliances and contractual commitments. You only need to ask yourself why MS and AOL (AOL TV) would enter into long term exclusive agreements with Gemstar.

Most if not all of Gemstar's problems to date have been with the monopolistic business practices of cable or PC to TV as your question is presented. Court victories have and continue to cause change. GIC has effectively removed itself from the guide platform beginning with its latest digital STB, the DCT 5000. AT&T Broadband is now free from liability with the pending merger or the licensing agreement if such should fail. TV Guide is either a part of Gemstar or a licensee. There are still some matters left with Pioneer, SFA and GIC but I see them more likely to be settled out of court rather than from court decisions.

Regards
Stew
