I doubt seriously that DOJ is contemplating the confiscation of Microsofts intellectual property. Tactically, it is certainly the wrong way to go and would only foster sympathy for Microsoft, the exact opposite of what DOJ has intended during the trial.

If declared a monopoly, MS will be subject to the same types of remedial actions that faced Standard Oil in the 20's. At least for their OS LOB.

If it is not settled, and MS is declard a monopoly, MS might find it beneficial to break itself up into separate operating units that would be able to compete free from monopolistic oversite.
