Richard Posner--even prior to becoming a federal appellate judge--was an academic giant for inventing the modern field of "law and economics," or the use of economic principles to explain and analyze law. He taught at the University of Chicago for years and was (to put it mildly) an innovative thinker on such wide-ranging issues as criminal law, divorce and family law, and virtually all regulatory issues. His scholarship has continued since he became a judge.

His views on antitrust will reflect the "performance" theory of antitrust favored by free market types, not the older "structure" theory which characterized antitrust thinking until William Baxter became Assistant Attorney General for Antitrust under Reagan.

Bottom line: Microsoft should trust this guy. It's unclear whether Joel Klein et al will want to follow Posner's instincts.

Hello Frank. Thank you. It feels good to be home again. I told you I would go back in when the time was ripe. Did you read the posts between Yaacov and me? He sent me a post stating that he heard there was serious talk about a settlement. I was shut out of SI for a while today and would have loved to read his post earlier. I bought 300 sh. of Msft earlier this afternoon and would have made up my mind earlier if I read his post earlier. Anyhow, I am happy with my timing. gg. Well, A.Glassman of DOW 36.000 fame was asked yesterday if he would buy Msft. Answer: Would I put all my money into Msft? No. Would I put most of my money into Msft? Yes.

Well, that got me thinking and I decided it was time to go back into Msft. And there was all this stuff from B.Gates about being very willing to settle. Too bad I did not buy more.

Finally. The Judge comes to his senses. Let's hope things work out well. We don't need our good cos. haunted. It looks like a very good mediator. I bet ya that McNealy is having a fit. Nah. Just kidding.
