Ed, <<why would Jensen deliberately fail to file?>> Maybe because the ledger is so dirty that shareholders would lynch him? Outrageous payments of stock to himself, shares for catalysts that don't do crap, illegal sale of unrestricted stock, etc. Shareholder's lawyers would have a field day. There would be more lawsuits than shares. However, if the plant works, everyone gets their money back in spades, all is forgiven and Jensen is a hero, shareholders will build him a church. BTW, this theory was conjecture I heard from another GPGI shareholder, it has considerable merit IMO.
