Regarding MSFT mediator. I see it had a very beneficial effect on MSFT stock afterhours. I personally still wouldnt bite on the bait. The judge appointed is known to be extremely bright. If the allegations we have informally heard from Scott are true, not to mention the findings of fact which MAKE THEM FACT now, I do not think this judge is going to be a pushover for MSFT. I suspect a settlement would be so unfavorable to MSFT that they would in fact decide to go to Appeal. If TWO judges should agree on the sins I think (not being a lawyer of course) they will have a difficult time at the Appellate level. Its just that they could drag the process out for a very long time. Technology being what it is, if they can hold out long enough it may become irrelevent but in the interim, once the initial enthusiasm for the Mediator passes stock could still suffer at least in the doldrums.
