DJ Microsoft: Arbitration 'Potentially Very Positive Step'

A clerk for Judge Posner confirmed late Friday the judge's appointment to mediate talks between the federal government and 19 states with Microsoft. But the clerk declined to make further comment.

There has been no initial meeting set between Posner and the parties. Jackson has left the scheduling of any meetings up to Posner.

Posner is known as an independent-minded conservative who issued a fiery dissent from a recent 7th Circuit decision that upheld certain restrictions on partial-birth abortions. He called the Wisconsin statutes that were upheld "pernicious and unconstitutional," and said they were designed mainly to rally public opinion against the landmark Roe vs. Wade decision that legalized abortion.

But Posner has sharply criticized President Clinton for the conduct that led to his impeachment trial. Indeed, Posner has already written a book on the impeachment and the tawdry events leading to it.

In his book, entitled "An Affair of State," Posner says that Clinton's continued denials were abhorrent. Truth, he wrote, "is an important social value, so we want people to respect rather than flout it."
