HS: This was discussed already last night - you are not the first one to see and be concerned about Lessig's role as amicus curii. It appears Jackson continues to ignore prior Appeals reversals such as the rebuke of a Special Referee (Lessig) and the inclusion of a browser in an O/S. JFD

I think to be fair, MSFT should be able to file a friend-of-the-MSFT brief on legal issues <ggg>.

I think the Judge now realizes his FOF were so skewed to the DOJ side and filled with some circular arguments. In retrospect he is attempting to show impartiality. I think it is great that Lessig gets to file a friend-of-the-court brief, for he truely is a friend of this court. I'm sure the appeals court feels no different about him and his bias against MSFT than it did in the past.
