Frank: Wouldn't be surprised if they were not encouraged to do this by the plaintiff attorneys i.e. DOJ and AG's of states involved. Obviously a last ditch effort to get MSFT to settle before they are exonerated on appeal. This whole ball of wax is going into melt down as public opinion is now becoming aroused in favor of MSFT. This also might be a tipoff that DOJ and MSFT enemies view Posner as a threat. This is definitely a premature time for filing this before the judge has released his conclusion in law. They are attempting to grasp the straw of finding of fact that MSFT is a monopoly (in the narrowest of definitions) and run with it before that element is removed or debunked in future litigation. The enemy has begun to act precipitously- the first stages of panic. In the meanwhile the MSFT strategy has been "Don't fire until you see the white's of their eyes." They have been sayiing that they are willing to negotiate as long as the co. is not broken up, their private property rights are not abridged and they are free to innovate without government interference. It all sounds reasonable to me and no doubt to Posner as well. Keep the faith Frank!JFD
