Dan, while I am not a lawyer, my experience tells me that if Judge Jackson does not issue a finding on the law (that is, if the lawsuit gets settled earlier), then legally there is no finding of guilt. Without that finding, it is harder for the plaintiffs in the private suits to proceed without proving that MSFT was actually violating one or more laws. So an out-of-court settlement does make things a little easier for MSFT, if they're smart enough to reach a settlement.
