I think you've made the argument yourself. The fact that an appeal will probably eventually reach the Supreme Court provides the best rationale for expediting the appeal. MSFT, meanwhile, if it declines to reach a settlement, thereby allowing the lower court to rule (most probably) against MSFT, creates a hand engraved invitation for all the private and class action plaintiffs to sue. MSFT may have violated the antitrust law, but I can't believe that they're also just plain stupid.
