Dennis, the date of the transaction was November 29. On that date, the stock was trading above $10. The suggestion by mooter, et. al., that the financing was priced 10-15 days prior to the event does not make sense. Warbucks could not take delivery of the shares until they were registered with the SEC, which was yesterday. No Warbucks in his right mind would agree to pricing his shares 10-15 days prior to delivery. In the event of a significant price decline, he could end up paying much more than the market price (at the time of delivery) for his shares. I seriously doubt it.
