why would it be illegal? In fact I think go-with-throttle-up had a similar theory and on that basis correctly called the upturn in the last hour yesterday. He believed that all the selling was in 200 or 300 share lots and the MM encouraged it, waiting in the wings then stepped in and soaked it all up in big block buys.
