Yes. The FTC appears to be ruthless:

....

'With the cold and flu season fast approaching, many consumers are looking for products to help them stay healthy or feel better,'' said Jodie Bernstein, director of the FTC's bureau of consumer protection. The settlement ''will help remind marketers of their responsibility to back up all advertising claims.''

Tax loss selling appears to work here, QGLY under $2 now, nearly at cash value.
And I thought $3 is the bottom when some funds threw out their shares in 50 and 100k block sizes back in September. It is not....

....

I wonder whether GUMM will ever back up its Zicam claims, if not, then lookout....

For the GUMM thread:

Interesting read:

FTC POLICY STATEMENT REGARDING ADVERTISING SUBSTANTIATION

amongst others:

"
Many ads contain express or implied statements regarding the amount of support the advertiser has for the product claim. When the substantiation claim is express (e.g.., "tests prove", "doctors recommend", and "studies show"), the Commission expects the firm to have at least the advertised level of substantiation. Of course, an ad may imply more substantiation than it expressly claims or may imply to consumers that the firm has a certain type of support; in such cases, the advertiser must possess the amount and type of substantiation the ad actually communicates to consumers.

"

The only thing that is going to be shut down is you Wexler. Liable per se will close you down. Zicam will only grow in stature and demand. Your shilling won't impress the FTC. That you think Zicam and Cold Eez are similar is another example of an ignorant comment. Stick to what you know, if there is anything.
