Elmer, We do know what the nature of the exclusivity deal that was made. I have no idea if there was any illegality at all. I am stating that financial incentives can be illegal. What if I went to your boss and paid him $100,000 on the quiet to terminate your employment with some excuse. Would that be illegal? I assume he declared the money and evaded no taxes. He was just afraid that your ideas were too good and your boss was too good a competitor with your services.
Since we lack the full details of the deal all we can do is surmise what is was that Intel and Gateway entered into. I am sure it was couched in terms that would try to defeat any anti-fair play or anti-trust implications, but as they say the final test of a duck(....walks, quacks etc)... means that if that contract ever sees the light of day and certain people apply the duck test to it.....well, it just might be a duck.
Was there any public tender by gateway for an exclusive CPU contract? was there in fact any type of exclusive cotract at all?....All I have seen was some inference of a deal in exchange for a low price Gateway did...?what?
now is gateway getting all then parts thay want because Intel is afraid of that deal being crooked? Is gateway in fact getting any more parts than any other maker in propotion to their size?(copperminus I mean)
So really until these questions are answered we have no grand conspiracy at all, just suspicions.
Now if they have indeed made a deal, we need an insider to blow the whistle or we will never know.
