U.S. Depicts Microsoft Acts as Part of an Illegal Pattern nytimes.com In which we learn of an "innovative" legal strategy by DoJ. Antitrust experts found the legal bundling of Microsoft's purported acts of anticompetitive behavior particularly intriguing -- especially since the legal brief was filed on the same day that the two sides gathered in Chicago for a second round of settlement talks with Richard A. Posner, a federal appellate judge serving as a mediator. "By making this pattern of practices argument, the government is saying that Microsoft is a fundamentally dangerous company and strongly suggesting that severe sanctions are required," said William Kovacic, a professor at the George Washington University law school. Hey, sauce for the goose is sauce for the gander. DoJ must be free to "innovate" by bundling too. Somewhat less sarcastically, this looks like more tea leaves pointing to "structural remedies", but that's just speculation on my part. Cheers, Dan.
