BEFORE THE BELL-VISX tumbles amid finding

NEW YORK, Dec 7 (Reuters) - Shares of VISX Inc. tumbled in pre-opening trade Tuesday after the
International Trade Commission made an initial finding in favor of a rival in a patent infringement case.

VISX, which makes lasers used to correct eyesight, was down at 48 on the Instinet electronic broker
system. The shares closed Monday at 88-1/8.

The company said after markets closed Monday that a judge of the International Trade Commission had
made an initial determination in favor of Japan's Nidek Co. Ltd. in a patent infringement dispute.

VISX said it would ask the full commission to review the finding.
