The patent ruling makes the standard or architecture of laser vision correction an open one.

Because of the traditional use of the term, open, it's easy to confuse that term with "non-proprietary," which is what I assume you meant to write. Remember that gorillas thrive on proprietary, open architectures while Kings thrive on non-proprietary, open architectures.

To further clarify the terminology which is vital to the understanding of this stuff, have you actually read and comprehended the ruling? I ask because I haven't. It's possible, depending on the patent under consideration and the nature of the ruling, that a gorilla game remains in play. If that's the case, VISX's lead in its quest to grab the crown is probably weakened considerably. That doesn't mean it's no longer a gorilla game.
