This not being able to short stocks under $5 thing is probably one of the oldest lies being spread across the net. You can short under $5 depending on who your broker is and their individual rules for trading. Call around and find yourself a broker who will allow you to do so.

I can tell you that you can do it via DLJ and a few others, just check it out yourself.
