If FEMA is so all-powerful an agency, why has't the President simply suspended the constitution and declared a national emergency already?

Who could stand in his way NOW, who, for some reason, wouldn't be able to stand in his way under an actual national emergency??

looks like my worst fears about FEMA are gathering some media ink. and Janelle and i have stocked up on alkamints, not rolaids.
