My take on the informal SEC inquiry by the division of enforcement, I think has to do with David Tice, and not really TYC. I think Tice shorted TYC shares and bought puts indirectly through associates, before releasing his negative opinion. This may not be a crime if his report was completely factual. I think the SEC is trying to determine whether his report is based on fact, or whether its based on false charges designed to make TYC shares tank. If the latter, he may be fined and/or imprisoned. If the former, he may get off free, and TYC will be in trouble.
