Isn't it a bit premature to launch a class action suit against TYC?

For an unrelated question: Can a lawyer or lawyers take on a class action case if they have any interest in the company in question? To be more specific, can lawyers who launch a class action against any company, not just TYC, have a short position in the company they are going after?

I am not insinuating this firm does--I've never even heard of this firm before. Its just a question I have never heard asked before here at SI when class actions pop up and I would like to know.
