IT Bill introduced in Lok Sabha

New Delhi, Dec 16

A bill seeking to effect suitable amendments to the existing laws for legal recognition of electronic records and digital signatures by the government and the judiciary was introduced in the Lok Sabha Thursday by Parliamentary Affairs and Information Technology Minister Pramod Mahajan.

According to the statement of objects of reasons of the Information Technology Bill, it will enable conclusion of contracts and creation of rights and obligations through electronic medium. It is proposed to provide a regulatory regime to supervise the certifying authorities issuing digital signature certificates.

To prevent possible misuse arising out of transcations and other dealings concluded over the electronic medium, it also seeks to create civil and criminal liabilities for contravention of the provisons of the proposed legislation.

The bill is sought to be enacted to facilitate an electronic governance by providing use and acceptance of electronic records and digital signatures in government offices and its agencies.

This will make citizens interact without hassles with the government. The State governments have supported the bill and said it should be accorded urgency, according to the statement.

The following are the salient features of the Information Technology Bill, 1999, introduced in the Lok Sabha:

* The bill follows the model law on electronic commerce adopted by the UN Commission on International Trade Law.

* Provides legal recognition to electronic data.

* Provides legal recognition to digital signatures.

* Seeks to appoint a Controller of certifying authorities.

* The Controller will be the repository of digital signature certificates.

* Seeks to grant licences to issue digital signature certificates.

* Seeks to appoint Cyber Regulations Appellate Tribunal.

* Network service providers not to be liable in some cases.

* Seeks suitable amendments in the Indian Penal Code, the Indian Evidence Act, the Bankers' Books Evidence Act and the Reserve Bank of India Act. UNI
