The 2nd Circuit case is essentially over. Nextel has no "standing" in the bankruptcy. Not much it can do. If FCC going to be paid fully, the only other matter (see press release) is maintaining qualification for C-block. Plan will be approved; the 2nd Circuit may never even issue its opinion if things move quickly enough; the case will be moot and be dismissed.
