As we live in different states, with different laws, I have no way of knowing how CPS operates in your state. I think every system, every organization, that I can think of, has flaws. Well-meaning people don't agree on much except black and white issues, and even then, not always. I would be happy to introduce you to a lawyer I know who used to be a County Attorney in charge of abuse cases, but finally had to quit because she was burned out. Things like the stepfather who raped an infant, and ripped her intestines, just got to her, finally. I used to serve as guardian ad litem in abuse and neglect cases, or as court appointed counsel for the parents who couldn't afford a lawyer, and I got burned out, too, but my level of tolerance wasn't very high to begin with. But because I represented parents accused of abuse and neglect, I can tell you that I never had reason to accuse CPS of abuse of due process. You would probably disagree with some of the things they thought were abuse. That's a far cry from lack of due process. If a child says she was assaulted, yes, CPS is going to take it very seriously, as they should. Sometimes people lie. Fathers who abuse their daughters lie, a lot. Pretty much all the time. And mothers whose husband is put out of the house get mad at their daughters. Emotionally disturbed mothers blame the daughters for the abuse, and the husband being out of the house, and finally, to please the mother, the daughter recants. That happens a LOT, Michael. I've seen it. How would YOU deal with a situation like that, where the daughter says she was lying in order to please the mother?
