nihil - The court would have no difficulty in distinquishing the Alcoa Case. In Alcoa, the company dominated an entire industry. In the case of NT, they only dominate one part of a market within an industry. That segment is OC-192 but OC-48 competes with OC-192 and when Lucent markets OC-768, it will compete with OC-192. I would argue that NTs temporary dominance in high speed networks actually promotes competition because it allows them to compete with Cisco and Lucent in other market segments. Cisco and Lucent both earn more profits than NT.
