The Globe and Mail reports in its Thursday, Dec. 23, edition that a
provincial court judge ordered the Ontario Securities Commission to hand
over hard copies of one million pages of documents to lawyers defending
John Felderhof, the chief exploration officer of Bre-X Minerals, against
insider trading charges. The Globe's Allan Robinson writes that the judge
ruled that the OSC's release to Joe Groia, Mr. Felderhof's lawyer, of 24
computer discs equivalent to 235 boxes of documents was not the same as
receiving printed copies of the documents. Mr. Groia charged that the OSC
was simply making what he described as a "massive data dump" just three
months before the trial, which is scheduled to begin March 20. An OSC
lawyer told the judge that printed copies of the relevant material had
already been handed over. Mr. Groia countered that huge amounts of
potentially vital information had never been disclosed in printed form,
including boxes of documents relating to investigations of the property
carried out by both Barrick Gold and Placer Dome.
