Michael and Thread, I remember a post from you some time ago about a January 6, 2000 date relating to the Lexar litigation. Was it a hearing on the injunction? I can't find your post. My recollection (without going backwards a few hundred posts) was that a motion for partial summary judgement against Lexar was to be heard in mid-January. Lexar tried to have the testimony of two of the witnesses for SanDisk stricken from the record. These testimonies related to certain statements by Lexar CEO that Lexar was aware (CEO reportedly made a verbal admission to this effect) that SNDK card assembly patents were infringed. This came to light during the negotiation of licensing fees. It appears that these statements are now contested. Regarding the injunction, that motion was previously submitted near the end of September and specifics of the injunction were to be submitted to the court within a given time frame. Lexar requested SanDisk to post bond a week or to later, perhaps in early October. I am not certain if a specific date has been set a judgement as to the exercising of the injunction or whether a hearing is required. Because of cost concerns I have not requested further legal documents since mid-November. Ausdauer
