Wal-Mart Online charges sales tax to residents of Utah, Arkansas and California.

This is important. We know why Arkansas due to management headquarters. Do you know where Fingerhut's distributions centers are located? I am also not sure that matters since that is subconracted.

Barnes and Noble charges sales tax in NJ, NY, TN and VA. Corporate headquarters are in New York and possibly a part in New Jersey. Tennesee and Virginia has distribution centers.

I am wondering if Walmart learned from last fall that contracting out fulfillment is not wise.

You have an opinion on the matter?

Don't you have to charge tax if you do business "in the state" - therefore, if you have a B&M operation there where customers are entitled to return items, then its a taxable transaction.

If the online presence is a separate legal entity then its no tax but then no returns.

I have to say, even I think this is unfair... some sort of standard tax will have to be levied for all online purchases is my guess - or take them all away.

Walmart is headquartered here in Arkansas, thus the requirement that they charge tax here. California, on the other hand, taxes everybody and everything. Not sure what the deal is in Utah; apparently they are deemed to have representation there, as well.
