I read this case some time ago. The basic premise was that if a state could fine the firm had a "nexus" in that state, sales tax may be applied. The definition of a nexus was left a little vague I believe intentionally for clarification later but presently a distribution center, operation center, etc. is considered a nexus. Barnes and Noble have their .com business as a separate firm so the nexus is only in three states which are NY, NJ and TN. TN is due to a distribution center. I do not know if Amazon is charging sales tax in Kansas or Nevada but they clearly have a nexus in those states not to mention Washington.
