Dave, Dave, Dave, 'Anything goes' IPR lotteries are the exception. Yes, you are quite right [though not in that 'black hole' post] that any change at all in implementation is indeed a change. To say that invalidates a patent is stretching a point. Most if not all serious 3G contenders seem to agree that it is stretching a point to superstring length since they all seem happy to pay Qualcomm [they are just haggling over the price].

Nokia has paid a piffling $30m to IDC with a view to getting around some patents. That's a small amount and maybe they are planning a re-run of the previous successful extraction of some funds from Qualcomm by Interdigital. The stakes are vastly higher now than then.

3G is in trouble from HDR. VW40 [aka W-CDMA] remains a fantasy. GSM is toast, which is different from 'future-proof'.

Quincy, Quincy, Quincy seems to have it figured out.

Tero, Tera, Tora, is lurking in the wings, puzzled at this sudden affliction of using everybody's names three times.

It must be a bummer [youthful colloquialism endemic around here] for the VW40 gang to be haggling over 3G IPR payments to Q! while Qualcomm does an end-run after hitting a homer with HDR. Still, they can make their GPRS play and attempt the Bleeding EDGE high flyer in a last desperate ploy to stay in the game.
