scarecrow, did they issue a cease and desist order instead of seeking an injunction? also, depending on what develops, he may yet be prosecuted... nothing prohibits the us attorney or doj from prosecuting criminally based on stuff the sec turns up.

scarecrow-- he made page 1 above the fold on today's new york times. his lawyer is trying to make a first amendment/internet issue out of it, but i think there's a big difference between people like me spouting ignorant (if sincerely held) opinions for free and people like him charging money to people to receive false and misleading information. i don't see the first amendment thing at all, but then his lawyers have to sat something...
