DMA,

I think the point here is that IF the IC were to go after Hillary while she was running a Senate campaign, it would be construed as "political" and you know how well the Clintons & the media have played the VRW conspiracy angle. She's trying to immunize herself against prosecution by running. I'm sure she feels that no one is going to dare to "attack" her. When she is the "victim" she rises in the polls, so Republicans are probably not too keen on having her prosecuted.
