I do not think it fails quite as soon as you say, but if and when it does, you take it back and the carrier replaces either the phone or the battery.

Just a note of caution. Before that happens, you should invest in the connectivity kit for the phone so that you can back up the numbers in your phone and then restore them back when you get the new one.
