Art,
I believe that there are inalienable rights as Mr. Kalb has suggested. However, I think that the "freedom" and "rights" that he keeps referring to are absurd if they are forced on a child by keeping him away from his father.

The believe that the founding fathers and 18th century view of rights would have taken the view that this is not an issue for the government, it is one to be resolved by the family. And this means his father since his mother is no longer living.

As long as there are people in power in the U.S. that operate at a jingoistic level, we will be seen as hypocrites who proclaim tolerance of other cultures, but certainly don't practice it.

If I was the father, I would be my choice to let Elian to grow up in a non-communist environment, I would use this as an opportunity to get the hell out myself. But the key word is "choice". If it is forced, it violates the whole idea of "rights" and "freedom".
