Anthony, no one can say for certain. However, I've served on government review boards before and can say that they like to have all their questions answered and can be very obstinate if the applicant balks.

The FDA panel rejected the SNRS data because of two reasons

1. The test results are really dismal if you look at some of the statistics. The regression is just a company smokescreen to cover up the fact that the doctors set out for "some improvement" vrs "correct the eyesight". Hence the slide that stated "properly managed expectation". Believe it or not, it was there on the SNRS website. It as well as all the potentially damaging pages were removed by the company.

2. The company did not provide the test data as requested by the panel.

I'm not currently short the stock. Any tips on how to play this thing if the application fails? Shorting is going to impossible Friday morning and I've read that the stock will be stopped Thursday because of the review.

I may be wrong on this, but it's my understanding SNRS's current application is for a lower standard of approval than they had in July; specifically they will ask for approval for temporary improvement only. If that is correct, then SNRS could conceivably get approval and still tank the stock. (See for example BTX [nee BTIM]).

SNRS vote- Yes on approval. Reasons:

1. Lehman put "Buy" rating Dec. 13th
2. Lehman pumps 11.7 Mil on Jan. 11th
3. The two most antaganistic panel
members won't be on this panel.
4. My M.D., Eve H., voting panel member, wouldn't
tell me her vote (of course). I surmised it would be yes.
5. Hopkins/Wilmer is sending Dr. Stark as a non-voting
panel member. He is a Big Gun and pro-SNRS.
6. Ultimately, the bar for approval has been lowered
and the FDA who scheduled this would not want a rejection.
