Justice just got done saying that they weren't in favor of breaking up MSFT

Actually, that's not what I've been reading. What I've been reading is that DOJ did agree with the states to propose a breakup of Microsoft to Posner, just not the version of a breakup being reported by USA Today.

USA Today reported earlier on Wednesday that the government
favored a breakup of the company, giving specifics of the way
the company would be restructured.
A Justice Department spokeswoman said the USA Today report
was inaccurate, without elaborating. "The story is inaccurate
in several important respects," the spokeswoman said. "It does
not accurately represent our views."
Others familiar with the case said USA Today was correct in
saying the government favored breaking up the company but
incorrect in the way it characterized how the government wants
the company to be restructured.


In my view a breakup is the one thing the DOJ and AGs really lust after and also the one thing they can't have if they litigate the case. And, if you believe Microsoft's propaganda about wanting freedom to innovate, a breakup is the least inconsistent with that of all the remedies proposed.

So my crazy theory about what the likely outcome of these talks will be holds.

All IMHO only, naturally.
