You should read the US press. Techweb reports the DOJ denying the accuracy of reports stating that they are calling for a break-up. For one, there is no legal precedence for such a punitive action and it would leave substantial grounds for MSFT to appeal. That would appear to be a strategic error on the part of the prosecution.

Very nice article by the Register. The comments about Mark Murray track my thinking exactly. I would only add that, if Microsoft were seriously considering a breakup, they would want a lot in return, which is all the more reason to take a hard line on it in the beginning. It would be interesting to know if Judge Posner felt out the two sides before telling the DOJ what ideas might or might not get the mediation ball rolling.

Another interesting question is whether, after DOJ and the AGs make this proposal to Posner on Monday, and if Microsoft decides not to deal, they will have the cojones to not ask Judge Jackson for the same relief. Me thinks not. Of course, asking Judge Posner and convincing Judge Jackson, then making it stick on appeal, are two completely different things. They better watch out -- their big egos could get them in a lot of trouble.
