voop, JDN: FCC has indicated an intention to re-auction in July. Clearly, the new auction can not proceed under the terms applicable to spectrum bid for by Nextwave and others in the C-block (I think it was). Spectrum will be put up for bid in pieces and not the whole lot purchased by Nextwave (it bid for spectrum in several metro areas--so it was never auctioned in one piece).

Depending on how and when the FCC structures the new auctions, and particularly what the applicable eligibility requirements for bidders are, one or more parties may cry foul, depending on who appears to be prejudiced. A crucial factor will be the analysis of whether the new auction requires new Congressional authorization, or whether the FCC will proceed under existing authority in respect of the C-bloc.
