I am not an attorney but did spend a number of years in business,(no bankrupt-sold it)but, in my opinion only, if the lawyer made such a suggestion and the client followed thru on his suggestion both would be guilty of deliberate fraud. Under Federal bankruptcy rules the applicant is allowed to retain certain assets such as his home. I do not believe the IRS is so constrained in taking the persons assets, as witness how assets are taken by the Fed, often with no proof of wrongdoing. None of what I have said should be taken as fact, only opinion, based on general experience
dealing with the IRS when I was in business. You do a lot of studying of the IRS rules as a small businessman. Large too, I am sure. K
