To me the most important implication of this merger timing is that JDSU is going to have killer earnings next week. If the market were to trash them this week, they must know the stock will get a big boost next week to support the merger. I'm putting on a bullish Feb options position.

I do wonder why they would possibly jeopardize the other merger with OCLI. Do you think they're afraid of CSCO buying ETEK? If so, investing in JDSU may be riskier than I think.

Steve, i think the risk is about the as the OCLI deal used to be---Approx. 10%. CNBC seems to be making comments about regulatory problems. I don't think JDSU sees it that way as they point out that NT and Lu also have component manufacturing capabilities as well.

Remember that only about 30% of the component biz is outsourced to companies like JDSU!
That should ease the regulators' concerns. Of course the other thing is that products will get to market faster and cheaper which could be a plus from the regulators point of view. Helps speed up the fibre optic networks.
