First Union Files A 'First'

First Union Bank has sued Princeton, N.J.-based Secure Commerce Services in federal district court, alleging that the company took customers' online banking information from the institution's Website without its consent and insecurely stored the data. E-commerce experts consider the lawsuit the first financial services industry legal action of its kind. Secure Commerce, a bill delivery and payment service doing business as Paytrust, is an "aggregator" that gathers a customer's financial information from other companies' Websites, at a customer's request. Last week, First Union announced new standards for such third parties, requiring them to sign a contract promising to meet certain bank data-security standards and mandating that bank customers must formally authorize the third-party relationship.
