Once the regulatory approval is obtained, then the discount will be similiar to what OCLI is trading at (1 to 2%) from what i recall. If i was buying shares, i would select OCLI if a discount is present. If i am a little aggressive i would select ETEK, which has not cleared the government yet. Holding ETEK will be dependent upon how well the stocks of other component manufacturers are doing such as SDLI----that is, if the whole sector moves the way JDSU/GLW/ORTL/SDLI have been going---i would think if the deal falls through, there would not be a significant drop in ETEk. In that case, the risk would be well worth it.
Again only if SDLI etc..gains in stride with JDSU.

Another factor is that mutual supply agreement is likely to remain even if the deal does not close.

IMHO, it will close---with possibily some minor conditions from the regulators.
