Gateway is correct to acknowledge athlon's TM rights. Amd has 5 separate TM registrations for athlon, each protecting a different logo or phrase. There are 10 other athlon registrations including sports magazines (football,golf and baseball), treadmills, youth sports trainers and sportswear. There are also registered Athlon service marks for hospitality and even financial services. Paul is correct that trespa also uses athlon for partitions, primarily office dividers, but he prefers to focus on their less attractive use.

Multiple use of a TM is fairly common. The only restraint occurs when confusion is likely to occur between classes of goods or when a mark has become famous enough to bar further use.
