Jay,

"If the judge is any good, he'll release his decision after the market is closed, allowing the info to be disseminated to all equitably."

If the judge is smart, he'd be buying shares of SNDK and then releasing his decision!!! Or at least this law clerk should.

Ha Ha Ha

When are earnings? and are we expecting a stock split to follow?

Jason

Jay,

I don't think there is any doubt that SanDisk must issue a news release regarding the decision, pro or con. SEC rules require disclosure of that type of information.

We have moved up so fast this week that I think momentum players are "buying on the rumor" of strong earnings. If we don't get very strong numbers, I'm afraid that the "sell on the news" could be brutal. We could be back at $70 pretty quickly. On the other, really strong numbers and . . .

Jay, Jason, Michael and Others,

If (and this is a big "if") anything is decided concretely today it would be difficult for SanDisk PR to contain themselves. The importance of the decision and the magnitude of the effort made thus far is too great to let a favorable decision sit idle for any length of time.
