Well, if the alleged infringement goes to a patent which protects technology which is the essence of the CF product, then Lexar would have only 2 choices is they lose: 1) work out a royalty agreement with SNDK, or 2) go out of business. This on top of the possibility of a substantial damage award. Obviously, 2 is not an option and 1 could have a dramatic effect on their financial condition. Additionally, depending on the result of the motions in February & March, it might all be academic. Mike G.
