A couple of interesting things to note regarding the Hitachi/RMBS litigation:

1. RMBS has some outstanding attorneys in this patent litigation. The lead (named) counsel is from Morris Nichols in Delaware, a firm with a prominent reputation locally, and nationally, in patent litigation. The Of Counsel are from Gray Cary in San Diego. They, too, are outstanding and recently acted as counsel in patent litigation in the Delaware District Court and prevailed in a jury trial.

2. Even more interesting, Gray Cary has represented Samsung on many occasions. Under the California Rules of Professional Conduct, they would likely have had to obtain Samsung's permission to represent RMBS because of the potential conflict of interest on the SDRAM issue. This suggests, to me, a high degree of cooperation between Samsung and RMBS on this issue, perhaps even implying that an agreement has been reached between Samsung and RMBS on the SDRAM question.
