The 40F is filed on behalf of the company, it can be approved on that basis by Nas/Sec. But actually applying for the listing brings into account the directors and insiders. There may be a hang up with that JMHO.

In the meantime brokerages have made a fortune off of this company, 10.00 warrants can be rolled for a two dollar profit without problem, with a "promise" of Nasdaq to come, they can continue to milk it.
